Privacy Policy

1. Preamble

L'Epicerie Créole is concerned to best protect the privacy of members of the L'Epicerie Créole platform (the "Platform"), and makes every effort in this context. L'Epicerie Créole undertakes in particular to ensure a level of protection of personal data in accordance with the General Data Protection Regulations ("GDPR"), including all French laws and regulations implementing, supplementing or replacing the GDPR. if applicable.

L'Epicerie Créole collects and processes personal data relating to Members. Members designate users who have registered on the Platform and whose registration has been validated by L'Epicerie Créole. This privacy policy (the “Privacy Policy”) describes the procedures for collecting and processing personal data relating to Members.

The processing of personal data is carried out by the company L'Epicerie Créole SAS, a simplified joint-stock company with share capital of €10,000, registered with the LYON Trade and Companies Register, under number 800 147 300, whose head office is located at 8 Chemin du Bois Tissot 69530 Brignais  (hereinafter, “L’Epicerie Créole”).

L'Epicerie Créole also collects data concerning Members, and more generally Platform users, through cookies, as more fully described in L'Epicerie Créole's cookie policy.

2. Personal data collected by L'Epicerie Créole

L'Epicerie Créole collects personal data directly from each Member, when they register on the Platform, and in particular:

  • information relating to his registration: his login, pseudonym and email address (the password, if collected, is then encrypted in a non-reversible manner and not collected as such);

  • information relating to the profile of the self-employed Member or sole proprietorship: his company name or company name, his surname and first name, his registration number if applicable, his VAT number, the address of his registered office, his contact details contact (telephone, e-mail), his Instagram username, a copy of the identity card or passport of the legal representative;

  • information relating to contacts within Members who are legal entities: the surname and first name of a natural person interlocutor, the surname and first name of the legal representatives or of any person duly authorized to bind the Member, and their respective contact details (telephone, E-mail) ;

  • information relating to product orders placed through the Platform: the product(s) purchased, the transaction number, the delivery address, etc. ;

  • bank details: RIB and SEPA mandate.
    Other data is collected directly from each Member for the duration of the use of the Platform,

    or when the Member communicates through the Platform, such as in particular:

  • the information that the Member provides when leaving a review on the Platform;

  • exchanges between Members (content of exchanges, nature of the complaint, return of products, etc.);

  • data relating to the consultation of emails that L'Epicerie Créole sends to Members (administrative emails

    or commercial prospecting);

    The data collected for the execution of the general conditions of use, the respect of our legal or regulatory obligations, or those which condition the conclusion of the general conditions of use must be provided. Failing this, L'Epicerie Créole will not be able to provide the functionalities of the Platform.

  

3. Purposes and legal bases for the collection of Members' personal data and retention period of the data by L'Epicerie Créole

L'Epicerie Créole collects the personal data of the Members listed in article 2 in order to provide them with the best possible service.

4. Recipients of personal data

The personal data collected and processed by L'Epicerie Créole may be communicated to the following recipients or categories of recipients:

● To natural persons authorized by L'Epicerie Créole to process Members' personal data, after having signed a confidentiality agreement, and in particular employees of L'Epicerie Créole;

● To other Members: the personal data of the Member who places an order via the Platform with another Member is transmitted to this Member. Each of these Members acts as a separate data controller;

● To carriers who will act under the responsibility of the Member shipping the order;

● To service providers to which L'Epicerie Créole subcontracts all or part of the processing carried out by L'Epicerie Créole relating to the personal data of Members, in particular:

o the payment service provider for secure online payment transactions: STRIPE;

o the Platform and data host;
o the Platform maintenance provider;
o the mailing service provider for sending transactional emails relating to orders

placed via the Platform;
o the email service provider for sending newsletters.

The subcontractors that L'Epicerie Créole uses provide the sufficient guarantees required by the applicable regulations on the protection of personal data. L'Epicerie Créole's subcontractors only have access to the data necessary for the performance of their services and are not authorized to process Members' data for other purposes.

●  To the financial partner of L'Epicerie Créole 

●  To the payment provider STRIPE, which acts as a separate data controller, in order to

enable it to fulfill its legal and regulatory obligations;

●  To the external advisers of L'Epicerie Créole: lawyers, accountants, auditors, etc., bound by an obligation of confidentiality;

●  To the authorities: the personal data of Members may be disclosed to the competent authorities in application of the law and/or a court decision;

●  To any third party in the event of a merger-acquisition, total or partial sale of assets, change of direct or indirect control, or any other form of restructuring implemented by L'Epicerie Créole

Members have the right to oppose the communication of their information to STRIPE at any time.

5. Duration of retention of personal data

L'Epicerie Créolene retains Members' personal information only for the time strictly necessary for the purposes set out in Article 3.

Members' data is then archived with restricted access for an additional period in order to allow L'Epicerie Créole to fulfill its legal and/or regulatory obligations in terms of archiving and data retention. At the end of this additional period, the Members' data will be permanently deleted from the L'Epicerie Créole databases.

6. Rights of Members

Members have a right of access, rectification, erasure and portability of their personal data, as well as a right of opposition, withdrawal of their consent and limitation of processing, under the conditions provided for by applicable regulations.

Members may, at any time, object to the processing of their data for commercial prospecting purposes or in accordance with applicable regulations.

Members can send their request to L'Epicerie Créole:

If Members believe that their rights have not been respected, they may lodge a complaint with the

Commission Nationale Informatique et Libertés (CNIL) or before any other competent authority.

7. Transfer of personal data of Members outside the European Union

No transfer of Members' personal data outside the European Union takes place. In particular, Members' personal data is hosted within the European Union.

8. Modification of the Privacy Policy

L'Epicerie Créole reserves the right to modify and/or update this Privacy Policy, in which case the Member will be duly informed. The revised Privacy Policy will be posted on the Platform with an indication of the last update date.
